The purpose of this privacy notice is to explain to you in the clearest way possible what information we collect, how we use it, and what rights you have in relation to it. If there are any terms in this privacy notice that you do not agree with, please discontinue use of our Services immediately.
2. What Information Do We Collect?
Personal information you disclose to us through the contact form
In Short: The only personal information we directly collect is what you voluntarily provide through our contact form, which is used solely to transmit your message to our email inbox. We do not save this information on our website.
When you use our contact form, you voluntarily provide us with personal information such as your name and email address, along with any message you send. This information is collected for the sole purpose of facilitating communication by sending it directly to our designated email inbox.
Our website does not store your contact form submissions on its servers or in any website database. Once the information is transmitted to our email system, its retention and management are governed by our email practices, separate from the website itself.
- Names (as provided in the contact form)
- Email addresses (as provided in the contact form)
All personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal information.
Information automatically collected (Operational and Security Data)
In Short: Like most websites, our servers may automatically log certain information for operational and security purposes, such as your IP address and browser/device characteristics when you visit our Website. This data is not linked to personal information submitted through our contact form.
When you visit, use, or navigate the Website, our web servers may automatically collect standard information. This information typically does not reveal your specific identity (like your name or contact information submitted through forms) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, general location (not precise geolocation), and other technical information. This information is primarily needed to:
- Maintain the security and operation of our Website (e.g., for troubleshooting, preventing fraudulent activity).
- Understand how our Website is being used in an aggregated way to improve its functionality and user experience.
This automatically collected data is separate from, and not linked to, any personal information you submit through our contact form. Spam prevention services like Google reCAPTCHA and Cloudflare Turnstile also collect information automatically as described in Section 4.
3. How Do We Use Your Information?
In Short: We use the information from your contact form solely to respond to your inquiries. Aggregated and anonymized operational data is used for website security and improvement.
We use the personal information collected via our contact form solely for the business purpose of responding to your inquiries and providing you with requested information or support.
The automatically collected operational and security data (as described in Section 2) is processed for the following purposes:
- To respond to user inquiries/offer support to users: We use the information you provide in the contact form (name, email, message) to reply to you. This processing occurs within our email system after the information has been transmitted from the website.
- To maintain security and operational integrity: Automatically logged data (like IP addresses) may be used to protect our services, prevent abuse, and troubleshoot issues.
- For service improvement (using aggregated data): We may analyze aggregated and anonymized data (which does not identify individuals) about website traffic and usage patterns to understand how our Website is used, identify trends, and improve our Website, products, marketing, and your experience. This analysis does not use personal information submitted through the contact form.
4. Will Your Information Be Shared With Anyone?
In Short: We do not sell your personal information. We only share information from the contact form with essential service providers for email transmission and spam prevention. We may disclose information if legally required.
We may process or share your data that we hold based on the following legal basis:
- Consent: We may process your data if you have given us specific consent to use your personal information for a specific purpose.
- Legitimate Interests: We may process your data when it is reasonably necessary to achieve our legitimate business interests.
- Performance of a Contract: Where we have entered into a contract with you, we may process your personal information to fulfill the terms of our contract.
- Legal Obligations: We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).
More specifically, we may need to process your data or share your personal information in the following situations:
- Service Providers: We engage third-party service providers to perform functions and provide services to us. We may share the information you provide in the contact form with such service providers, but only to the extent necessary to perform these functions and provide such services. They are contractually obligated to maintain the confidentiality and security of your data. Examples include:
- Email Delivery Services (SMTP Providers): When you contact us via our contact form, your name, email address, and the content of your message are processed by our email provider (e.g., the service configured with Nodemailer) to deliver the email to us. This processing is for the sole purpose of email transmission. The website itself does not store this information after transmission.
- Hosting Providers: Our website is hosted by a third-party hosting provider. While your data transits through their servers when you submit the contact form (as part of the email sending process), we do not use our hosting provider to store your personal information from contact form submissions in a database or any persistent storage on the web server that we manage or access. The data exists on their systems only transiently as necessary for the operation of the website and email transmission.
- Data Analysis Services (Aggregated Data): We may use third-party services to help us understand website traffic and usage patterns. These services typically collect aggregated and anonymized data (such as browser types, pages visited, time spent on site) and do not process the personal information you submit through our contact form for their analytics.
- Spam Prevention: To protect our Website and services from spam and abuse, we use third-party services Google reCAPTCHA and Cloudflare Turnstile on our contact forms or other relevant user interaction points.
- Google reCAPTCHA: This service is provided by Google LLC. When you use forms protected by reCAPTCHA, your interaction is subject to the Google Privacy Policy and Terms of Service. Google analyzes various information (such as IP address, mouse movements, and time spent on the page) to determine if the user is a human or a bot.
- Cloudflare Turnstile: This service is provided by Cloudflare, Inc. When you use forms protected by Turnstile, your interaction is subject to the Cloudflare Privacy Policy. Cloudflare Turnstile helps us identify and block automated abuse without requiring users to solve a visual puzzle.
5. How Long Do We Keep Your Information?
In Short: Our website does not keep your contact form information. It is transmitted to our email system, where retention is governed by our email management practices and legal requirements.
Our Website does not store personal information submitted through the contact form. This information is transmitted directly to our email system. Therefore, the retention of your personal information (name, email, message content) is determined by how long it is needed within our email system to address your inquiry, for follow-up correspondence, and for our business records, or as required by law (such as tax, accounting, or other legal requirements).
When we have no ongoing legitimate business need to process your personal information received via email (for example, once your inquiry is fully resolved and no further follow-up is anticipated), we will either delete or anonymize such information from our email system where feasible. If this is not possible (for example, because your personal information has been stored in email backup archives), then we will securely store your personal information within our email system and isolate it from any further processing until deletion is possible. Operational data automatically logged by our web server for security and functionality is typically kept for a limited period as per standard server logging practices.
6. How Do We Keep Your Information Safe?
In Short: We aim to protect your personal information through a system of organizational and technical security measures.
We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process (primarily data in transit and within our email systems post-transmission). For instance, our website uses HTTPS to encrypt data transmitted between your browser and our server, and we employ various security headers (as configured in our Next.js application, including Content Security Policy, Strict-Transport-Security, X-Content-Type-Options, X-Frame-Options, and X-XSS-Protection) to help protect our website and the transmission of your information.
7. Do We Collect Information From Minors?
In Short: We do not knowingly collect personal information via our contact form from children under 18 years of age, and our Website and Services are not directed to them.
Our Website and Services are not intended for or directed at children under 18 years of age. We do not knowingly solicit or collect personal information from children under 18 years of age through our contact form.
If we learn that we have inadvertently received personal information from a child under 18 years of age that was submitted through our contact form without verifiable parental consent, we will take reasonable steps to delete that information from our email records.
If you are a parent or guardian and you believe your child has provided us with personal information through our contact form without your consent, please contact us using the information provided on our contact page so that we can take appropriate action.
8. What Are Your Privacy Rights?
In Short: In some regions, such as the European Economic Area (EEA), United Kingdom (UK), and California, you have rights that allow you greater access to and control over your personal information. You may review, change, or request deletion of your data.
Depending on your location, you may have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; and (iv) if applicable, to data portability. In certain circumstances, you may also have the right to object to the processing of your personal information.
To make such a request, please use the contact details provided on our contact page. We will consider and act upon any request in accordance with applicable data protection laws.
If you are located in the EEA or UK and you believe we are unlawfully processing your personal information, you also have the right to complain to your local data protection supervisory authority. You can find their contact details here: EDPB Members.
If you are a resident in Switzerland, the contact details for the data protection authorities are available here: FDPIC.
9. Controls for Do-Not-Track Features
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.
10. Do California Residents Have Specific Privacy Rights?
In Short: Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information.
California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. As we primarily collect contact information for direct communication and do not sell or share it for third-party direct marketing, this is generally not applicable. However, if you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided on our contact page.
If you are under 18 years of age, reside in California, and have a registered account with the Website (Note: our website does not currently offer user accounts), you have the right to request removal of unwanted data that you publicly post on the Website. To request removal of such data, please contact us using the contact information provided, and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Website, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g. backups, etc.).
Further, the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA) provide California residents with specific rights regarding their personal information. This includes the right to know, the right to delete, the right to opt-out of sale/sharing of personal information (App Cybernetica does not currently "sell" or "share" personal information as defined by CCPA/CPRA), and the right to non-discrimination for exercising these rights. For any requests regarding your CCPA/CPRA rights concerning the information you've sent us via email, please contact us. We strongly encourage you to review resources provided by the California Attorney General for a full understanding of your rights.
11. Do We Make Updates To This Notice?
In Short: Yes, we will update this notice as necessary to stay compliant with relevant laws.
We may update this privacy notice from time to time. The updated version will be indicated by an updated "Last Updated" date and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy notice, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this privacy notice frequently to be informed of how we are protecting your information.
